New property rights guide for people living on-reserve on PEI

With generous support from the Mi’kmaq Confederacy of Prince Edward Island (MCPEI), Community Legal Information is launching a new publication called Property Rights: A Guide for People Living on Reserve on PEI.

Property laws that apply on First Nation reserves located on Prince Edward Island (PEI) are different from the laws that apply off-reserve. Property laws also differ between Abegweit First Nation and Lennox Island First Nation reserves.

These differences can make it hard for people living on-reserve to identify the property laws that apply to their situation.

This resource may be helpful if you live on an Abegweit First Nation, or on a Lennox Island First Nation reserve, and you have questions about:

  • Your rights to use, live on, and benefit from a specific piece of land on-reserve
  • Transferring your rights to a piece of land on-reserve to another First Nation member
  • Making an effective will
  • Your rights to your family home if your spouse dies
  • Dividing assets after a separation
  • Your rights to your family home if there’s an Emergency protection order
  • This publication can also help service providers understand and share information about laws, legal processes, and legal options relevant to people who live on Abegweit First Nation, or Lennox Island First Nation reserves.
